These terms of use apply between Simon Schillinger Tränkestraße 20 79114 Freiburg, Germany (hereinafter "Provider") and users of the free mobile application "MapShot" (hereinafter "App"), available on the Apple App Store and Google Play. The App is used to view and explore calibrated panoramic images with overlaid landscape information. No user account is required. By using the App, the user agrees to these terms.
The App and the content provided therein (in particular panoramic images, map data, and software) are protected by copyright and trademark law. The user receives a simple, non-transferable right to use the App for personal purposes on their own devices upon installation. It is not permitted to decompile, reverse-engineer, modify, create derivative works from, or redistribute the App or its content.
The Provider does not guarantee the accuracy, timeliness, or completeness of the content provided in the App. Availability of the App may be limited by maintenance, technical issues, or dependencies on third-party services (e.g., internet connection, map services). The Provider is liable without limitation in cases of intent or gross negligence, as well as for injury to life, body, or health. For slight negligence, the Provider is only liable for breaches of material contractual obligations, limited to foreseeable, contract-typical damages.

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not restrict mandatory legal provisions of their country of residence. The place of jurisdiction for users who are not consumers or who do not have a general place of jurisdiction in Germany is Freiburg im Breisgau. The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. The Provider is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board. Amendments to these terms require text form. Should individual provisions be invalid, the remaining provisions shall remain in effect.
